NOTICE: Pursuant to Lake Forest Municipal Code Section 2.04.010, Regular Meetings of the City Council are held the First and Third Tuesday of each month at the hour of 5:30 p.m. for Closed Session matters, if required. The Public Session of the meeting shall commence at 6:30 p.m. or as soon thereafter as possible. Special Meeting times may be held at a different time and date as listed on the Agenda.

AGENDA DOCUMENT REVIEW: The Agenda and staff reports are available on the Internet at
www.lakeforestca.gov and at the City Clerk’s Office, 100 Civic Center Drive, Lake Forest, California, on the Friday before the meeting on Tuesday.

AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice to members of the public of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff’s recommendation. The City Council may take any action which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action.


AGENDA ON SOCIAL MEDIA: This meeting will be streamed through Facebook Live. Comments will not be taken via Facebook Live. To ensure that the City Council receives your comments, you may submit written comments or voicemail messages to the City Clerk prior to the meeting.  The City provides the Facebook Live stream as an additional service to the public.  However, the City cannot guarantee that its network and/or the site will be uninterrupted.  The City is not responsible for any interrupted service.  

SPECIAL NOTICE REGARDING PUBLIC PARTICIPATION AND COMMENT DURING CORONAVIRUS (COVID-19) PANDEMIC:

EXECUTIVE ORDER
: On March 4, 2020, Governor Newsom proclaimed a State Emergency in California as a result of the threat of COVID-19. On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allows a local legislative body to hold public meetings via teleconferencing and to make public meetings accessible electronically to all members of the public seeking to observe and address the local legislative body. Pursuant to Executive Order N-29-20, please be advised that the City of Lake Forest City Council may participate at meetings by teleconference.

PUBLIC PARTICIPATION:  Pursuant to Executive Order N-29-20 and given the current health concerns, members of the public can access meetings live on our website at https://lakeforestca.gov/129/Agendas. The City Council Chambers will be closed to the public.

PUBLIC COMMENT PRIOR TO THE MEETING: Members of the public may submit e-comments to council@lakeforestca.gov or a voicemail message by calling (949) 461-3455. E-comments will not be read at the meeting. Voicemail messages will be played at the meeting and will be limited to three minutes, per speaker. To ensure staff reviews all comments prior to the City Council meeting, please submit email or voicemail comments no later than 5:00 p.m. the day of the meeting. E-comments comments received after said time will be uploaded to the agenda packet and made part of the official public record of the meeting.

CLOSED SESSION PUBLIC COMMENT:                                                                                                        5:30 p.m.

At this time, members of the public may address the City Council regarding any items listed on the Closed Session agenda.  No action may be taken on items not listed on the agenda unless authorized by law.  Comments shall be limited to three minutes per person.
Any person wishing to address the City Council on a Closed Session matter is requested to complete a "Request to Speak" form available at the door.  The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council.
Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally.

10.
AUTHORIZE CONSTRUCTION CHANGE ORDER TO REPAIR ADDITIONAL PAVEMENT LOCATIONS IDENTIFIED IN SLURRY SEAL ZONE G (PORTOLA HILLS) AND ADJACENT TO BAKE PARKWAY AND TRABUCO ROAD
 
RECOMMENDED ACTION: Approve Contract Change Order No. 1 to the agreement with American Asphalt South, Inc. in the amount of $478,400 for the Slurry Seal Project for Non-Arterial Streets, Zone C (PW 2019-05A); Slurry Seal Project for Non-Arterial Streets, Zone G (PW 2020-05A); and Park Parking Lot Resurfacing (PW 2020-12) to repair additional deteriorated pavement within Zone G (Portola Hills) and to repair pavement on Trabuco Road south of Bake Parkway. Authorize the City Manager to sign, the City Clerk to attest, the Contract Change Orders, substantially in the form attached.
 
11.
AWARD CONSTRUCTION CONTRACT FOR NEIGHBORHOOD PARK RENOVATIONS: DARRIN PARK, MONTBURY PARK, AND PEBBLE CREEK PARK (PW 2017-17B)
 
RECOMMENDED ACTION: 1. Approve contract documents for construction of Neighborhood Park Renovations: Darrin Park, Montbury Park, and Pebble Creek Park. 2. Award a contract in the amount of $1,264,272.62 to Horizons Construction Company International, Inc. 3. Reject all other bids received and authorize return of the bid bonds upon receipt of the executed contract documents from Horizons Construction Company International, Inc. 4. Authorize the Mayor to sign, and the City Clerk to attest the contract with Horizons Construction Company International, Inc.
 
12.
SECOND AMENDMENT TO THE AGREEMENT WITH WALLACE AND ASSOCIATES FOR CONSTRUCTION ADMINISTRATION AND CONSTRUCTION INSPECTION SERVICES
 
RECOMMENDED ACTION: 1. Approve the Second Amendment to the agreement for construction administration and construction inspection services with Wallace and Associates, Inc. 2. Authorize the Mayor to sign, and the City Clerk to attest, the Second Amendment substantially in the form attached.

13.

AN ORDINANCE AMENDING CHAPTER 13.20 AND 13.28 OF THE LAKE FOREST MUNICIPAL CODE REGARDING USE OF CIVIC CENTER AND ITS RELATED FACILITIES AT NIGHT

RECOMMENDED ACTION: 1. Introduce for first reading an Ordinance entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE FOREST, CALIFORNIA AMENDING CHAPTERS 13.20 AND 13.28 OF TITLE 13 OF THE LAKE FOREST MUNICIPAL CODE REGARDING CAMPING ON PUBLIC PROPERTY AND USE OF THE CIVIC CENTER AND ITS RELATED FACILITIES; and 2. Find that the proposed Ordinance is exempt from CEQA under State CEQA Guidelines section 15061(b)(3).
 

14.

CONSIDERATION OF APPOINTMENTS TO CITY COMMISSIONS

RECOMMENDED ACTION: SELECT FROM THE FOLLOWING: Council Member Cirbo make one (1) Appointment to the Planning Commission, one (1) Appointment to the Traffic and Parking Commission and one (1) Appointment to the Community Services Commission, Mayor Pro Tem Pequeno make one (1) Appointment to the Planning Commission, one (1) Appointment to the Traffic and Parking Commission and one (1) Appointment to the Community Services Commission, Mayor Voigts make one (1) Appointment to the Traffic and Parking Commission.
 

15.

SUBMITTAL OF QUESTIONS AND CONCERNS REGARDING THE ORANGE COUNTY POWER AUTHORITY AND JOINT POWERS AGREEMENT TO ITS BOARD OF DIRECTORS

RECOMMENDED ACTION: Receive a presentation regarding the questions, concerns, and recommendations identified by the City Council, and drafted by the Community Choice Aggregation Ad-Hoc Subcommittee; and Authorize the Mayor to sign the letter; and Direct staff to submit the letter to the Board.
 

16.

CONSIDERATION OF ADDING A COMMUNITY CHOICE AGGREGATION BALLOT MEASURE ON A STAND-ALONE ELECTION SCHEDULED FOR NOVEMBER 9, 2021

RECOMMENDED ACTION: Exercise City Council discretion.

At this time, the City Manager may comment on agenda and non-agenda items; and report on items of interest to the City Council and community.

At this time, City Council Members may comment on agenda or non-agenda matters. No discussion may take place on any item not appearing on the posted agenda. Council Members may ask a question for clarification, respond to statements made or questions posed by the public, make a brief announcement, or make a brief report on his or her own activities. In addition, the City Council may refer to staff or other resources for factual information, request staff to report back at a subsequent meeting or direct staff to place a matter of business on a future agenda. No action may be taken on non-agenda matters unless authorized by law (Government Code Section 54954.2).
