NOTICE: Pursuant to Lake Forest Municipal Code Section 2.04.010, Regular Meetings of the City Council are held the First and Third Tuesday of each month at the hour of 5:30 p.m. for Closed Session matters, if required. The Public Session of the meeting shall commence at 6:30 p.m. or as soon thereafter as possible. Special Meeting times may be held at a different time and date as listed on the Agenda.

AGENDA DOCUMENT REVIEW: The Agenda and staff reports are available on the Internet at https://www.lakeforestca.gov/en/government/meeting-agendas-and-minutes/meeting-agendas and at the City Clerk’s Office, 100 Civic Center Drive, Lake Forest, California, on the Friday before the meeting on Tuesday.

AGENDA DESCRIPTION: The Agenda descriptions are intended to give notice to members of the public of a general summary of items of business to be transacted or discussed. The listed Recommended Action represents staff’s recommendation. The City Council may take any action which it deems to be appropriate on the agenda item and is not limited in any way by the recommended action.

AGENDA ON SOCIAL MEDIA: This meeting will be streamed through Facebook Live. Comments will not be taken via Facebook Live. The City provides the Facebook Live stream as an additional service to the public. However, the City cannot guarantee that its network and/or the site will be uninterrupted. The City is not responsible for any interrupted service.

PUBLIC COMMENT PRIOR TO THE MEETING: Members of the public may submit email comments to [email protected]. Email comments will be uploaded to the agenda packet and made part of the official public record of the meeting and will not be read at the meeting. To ensure staff reviews all comments prior to the City Council meeting, please submit email comments no later than 5:00 p.m. the day of the meeting.

PUBLIC COMMENT: Members of the public may provide comments in-person at the meeting. Public comments will no longer be accepted remotely. Those wishing to provide comments in-person at the meeting will be asked to submit a request to speak to the City Clerk.

CLOSED SESSION PUBLIC COMMENT: 
CLOSED SESSION:  At this time, the City Council may recess to Closed Session for conference with Legal Counsel to discuss the items listed below pursuant to Government Code requirements.  Any items not concluded by 6:30 p.m. may be continued to the end of the Public Session. At this time, members of the public may address the City Council regarding any items listed on the Closed Session agenda.  No action may be taken on items not listed on the agenda unless authorized by law.  Comments shall be limited to three minutes per item. Any person wishing to address the City Council on a Closed Session matter is requested to complete a "Request to Speak" form available at agenda public review table near the entrance. The completed form is to be submitted to the City Clerk prior to an individual being heard by the City Council. Whenever possible, lengthy testimony should be presented to the City Council in writing (8 copies) and only pertinent points presented orally.

RECOMMENDED ACTION: Said Ordinances and Resolutions which appear on the public agenda shall be determined to have been read by title and further reading waived.

RECOMMENDED ACTION: Approve as submitted.

MINUTES OF THE BUDGET WORKSHOP OF THE CITY COUNCIL HELD ON MAY 23, 2023

RECOMMENDED ACTION: Approve as submitted.
 

6.

AGREEMENT FOR TRAFFIC SIGNAL MAINTENANCE SERVICES

RECOMMENDED ACTION: 1. Award an Agreement for Traffic Signal Maintenance Services in the amount of $1,837,017 to Bear Electrical Solutions, Inc.; and 2. Authorize the Mayor to sign, and the City Clerk to attest, the award of Agreement to Bear Electrical Solutions, Inc., substantially in the form attached.
 

7.

AWARD OF CONTRACT FOR MEDIANS, PARKWAYS, AND SLOPES LANDSCAPE MAINTENANCE SERVICES

RECOMMENDED ACTION: 1. Award an Agreement for Maintenance Services in the amount of $4,036,680 to Nieves Landscaping, Inc., of Santa Ana, California for Medians, Parkways and Slopes Landscape Maintenance Services. 2. Authorize the Mayor to sign, and the City Clerk to attest, the award of contract to Nieves Landscaping, Inc., of Santa Ana, California, substantially in the form attached.
 

8.

AWARD OF CONTRACT FOR PASSIVE PARK LANDSCAPE AND RESTROOM MAINTENANCE SERVICES

RECOMMENDED ACTION: 1. Award an Agreement for Maintenance Services of $3,365,770.80 to Nieves Landscaping, Inc., of Santa Ana, California, for Passive Park Landscape and Restroom Maintenance Services. 2. Authorize the Mayor to sign, and the City Clerk to attest, the award of contract to Nieves Landscaping, Inc., of Santa Ana, California, substantially in the form attached.
 

9.

INDEPENDENCE DAY PARADE ROAD CLOSURES AND RELATED ACTIVITIES ON JULY 4, 2023

RECOMMENDED ACTION: 1. Approve road closures of race and parade route from 5:00 a.m. - 2:00 p.m. on July 4, 2023. 2. Direct Public Works to provide required traffic control devices and crews for road closures. 3. Direct the Orange County Sheriff’s Department to staff road closures and patrol events. 4. Approve additional street sweeping of the route.
 

10.

UPDATED 2023 IMPLEMENTATION GUIDELINES FOR THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)

RECOMMENDED ACTION: Adopt a Resolution Entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE FOREST, CALIFORNIA, AMENDING AND ADOPTING LOCAL GUIDELINES FOR IMPLEMENTING THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (PUB. RESOURCES CODE 21000 ET SEQ.)
 

11.

THIRD AMENDMENT TO THE AGREEMENT WITH THOMAS J. O’CONNELL DBA LAKE FOREST ELECTRIC FOR ELECTRICAL MAINTENANCE SERVICES

RECOMMENDED ACTION: 1. Approve the Third Amendment to the Agreement with Thomas J. O'Connell DBA Lake Forest Electric for Electrical Maintenance Services 2. Authorize the Mayor to sign, and the City Clerk to attest, the Third Amendment substantially in the form attached
 

12.

Interim Appointment for the Position of Deputy City Manager and Adopting a Resolution Authorizing the Hiring a Retired Annuitant.

RECOMMENDED ACTION: 1. Adopt a Resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE FOREST, CALIFORNIA, APPOINTING DONALD J. WHITE AS DEPUTY CITY MANAGER ON AN INTERIM BASIS AND APPROVING EMPLOYMENT AGREEMENT. 2. Authorize the Mayor to sign, and the City Clerk attest to, the employment agreement with Donald White, in the form attached.
 

13.

SECOND AMENDMENT TO THE AGREEMENT WITH ALL CITY MANAGEMENT SERVICES, INC.

RECOMMENDED ACTION: 1. Approve the Second Amendment to the Professional Services Agreement with All City Management Services, Inc. 2. Authorize the Mayor to sign, and the City Clerk to attest, the Second Amendment to the Professional Services Agreement substantially, in the form attached.
 

14.

AWARD OF CONTRACT FOR FINANCIAL AND SPECIAL AUDIT SERVICES

RECOMMENDED ACTION: 1. Award Professional Consultant Services Agreement to CliftonLarsonAllen LLP (“CLA”) in the amount of $233,060.00 for Financial and Special Audit Services. 2. Authorize the Mayor to sign, and the City Clerk to attest, the agreement with CLA, substantially in the form attached.
 

PUBLIC HEARING(S)  (Item No. 15)
Public Hearings are scheduled for a time certain of 6:30 p.m. or as soon thereafter as possible. City Council, when considering the matter scheduled for hearing, will take the following actions: 1. Open the Public Hearing. 2. Receive staff report. 3. Accept public testimony. 4. City Council comments and questions. 5. Close the Public Hearing and take appropriate action.

CITY-INITIATED ORDINANCES TO AMEND TITLES 5 AND 9 OF THE LAKE FOREST MUNICIPAL CODE TO ADDRESS LOW BARRIER NAVIGATION CENTERS, TRANSITIONAL AND SUPPORTIVE HOUSING, STREAMLINED REVIEW OF ELIGIBLE PROJECTS, EMPLOYEE HOUSING, EMERGENCY SHELTER PARKING, AND RESIDENTIAL CARE FACILITIES AND FINDING THE ACTIONS TO BE EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINES SECTIONS 15060(C)(1) AND 15061(B)(3)

RECOMMENDED ACTION: 1. Introduce First Reading of an Ordinance No. ____ entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE FOREST, CALIFORNIA, AMENDING TITLE 9 OF THE LAKE FOREST MUNICIPAL CODE TO ADDRESS LOW BARRIER NAVIGATION CENTERS, TRANSITIONAL AND SUPPORTIVE HOUSING, STREAMLINED REVIEW OF ELIGIBLE PROJECTS, EMPLOYEE HOUSING, EMERGENCY SHELTER PARKING, AND RESIDENTIAL CARE FACILITIES AND FINDING THE ACTION TO BE EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINES SECTIONS 15060(c)(1) AND 15061(b)(3). 2. Introduce First Reading of an Ordinance No. _____ entitled: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE FOREST, CALIFORNIA, ADDING CHAPTER 5.44 TO THE LAKE FOREST MUNICIPAL CODE REGARDING RESIDENTIAL CARE FACILITIES AND FINDING THE ACTION TO BE EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINES SECTIONS 15060(c)(1) AND 15061(b)(3).

16.

AGREEMENT WITH THE COUNTY OF ORANGE FOR LAW ENFORCEMENT SERVICES

RECOMMENDED ACTION: Approve and authorize the Mayor to sign the Agreement with the County of Orange for Law Enforcement Services for Fiscal Year 2023-24.
 

17.

MISCELLANEOUS BUDGET ITEMS

RECOMMENDED ACTION: 1. Receive presentations on the Financial Management and Budgetary Policy and General Fund Reserve Risk Analysis. 2. Approve the proposed changes to the City’s Financial Management and Budgetary Policy. 3. Review and provide feedback regarding the General Fund Risk Reserve Analysis.
